Last updated: DRAFT 16 Oct 2026, set on launch
In short: a booking is confirmed by your 50% deposit, and the balance is due when the project is complete. I keep the copyright, and you get a licence to use the finished work once it's paid for. Your quote or project agreement sets out the specifics. If you're a consumer, none of this affects your legal rights.
1. About these terms
These terms apply to this website and to any video or photography services you book with KJG Media, the trading name of Kian Goddard, a sole trader. Address: business address needed. Email: kian@kjgmedia.co.uk.
Your quote or project agreement forms part of these terms. If they conflict, the quote or agreement wins. The Cancellations & Refunds policy also forms part of these terms.
Some sections treat consumers and businesses differently. You're a consumer if you're booking for personal use, not for a business, trade or profession.
Part A: Using this website
2. Content
All images, videos, text and branding on this site belong to KJG Media or are used with permission from clients and contributors. Please don't copy, download or reuse them without written permission. KJG Media® is a UK registered trade mark (UK00004171626).
3. Accuracy and links
I keep this site up to date, but it's general information, not an offer. Every project is quoted individually. Links to other sites are for convenience, and I'm not responsible for their content.
Part B: Booking video and photography
4. Quotes
Quotes are based on the brief you give me and are valid for 14 days. If the brief changes, for example extra shoot time, locations, deliverables or usage, I'll re-quote before doing the extra work.
5. Booking and payment
- Your booking is confirmed once you've accepted the quote or agreement in writing and paid a 50% deposit. Dates aren't held until then.
- The remaining 50% is due on completion of the project. Watermarked previews are shared during the edit. Full-resolution files are released once the balance has cleared.
- Invoices are payable within 14 days unless your agreement says otherwise.
- For business clients, I may charge statutory interest and compensation on late payments under the Late Payment of Commercial Debts (Interest) Act 1998.
- Ongoing content arrangements are invoiced as set out in the agreement.
6. Your responsibilities
- Give accurate information and timely access to the people, places and materials the project needs.
- Get any permissions needed for locations you arrange, and make sure people you bring to the shoot are happy to be filmed or photographed. I can supply release forms.
- Make sure any logos, music, footage or other material you give me is yours to use, or licensed for this use.
- If delays you cause extend the shoot or edit beyond what was quoted, extra time may be charged at your hourly/day rate, agreed with you first.
7. Editing, revisions and delivery
- Two rounds of revisions are included as standard, unless your quote says otherwise. Further changes are quoted separately.
- Please send feedback within 14 days of receiving each draft, so the project keeps moving.
- Delivery dates in your quote are estimates. I'll tell you as early as possible if anything changes.
- Files are delivered by download link (currently Google Drive, or Pixieset for photo galleries), available for 14 days. Please keep your own backups. I archive projects for 12 months but can't guarantee files will be available after delivery.
- Raw footage and unedited photos aren't included unless your quote says so.
- The edit, grade and selection of images follow the agreed brief and the style shown in my portfolio. A difference in personal taste isn't a defect, but I'll always work with you to get it right within the included revisions.
8. Copyright and your licence to use the work
Under UK law, the person who creates a photo or video owns the copyright unless it's transferred in writing. KJG Media keeps the copyright in all work it creates. Once you've paid in full, you get a non-exclusive, worldwide licence to use the final deliverables for the uses set out in your quote. Default: your own website, social media and organic marketing. Paid advertising, broadcast, resale or third-party use need agreeing separately. Please don't alter the work beyond reasonable cropping or resizing for each platform without asking.
Music in your edit is either licensed from a library such as Epidemic Sound or composed originally for the project, and is cleared for the platforms and uses agreed. Using it elsewhere may need a separate licence.
9. Portfolio use
I may show the work in my portfolio, showreels and social media. If your project needs to stay private, for example for confidentiality, an embargo or an unreleased product, tell me before the shoot and we'll agree it in writing.
10. Cancellations
See Cancellations & Refunds, which includes your 14-day cancellation rights if you're a consumer.
11. Things outside anyone's control
If something outside my reasonable control (such as severe weather, serious illness, travel disruption or venue closure) stops a shoot going ahead, we'll reschedule. If that isn't possible, see the Cancellations & Refunds policy.
12. Liability
- Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else the law doesn't allow to be limited.
- If you're a consumer: I'm responsible for loss or damage you suffer that's a foreseeable result of me breaking these terms or failing to use reasonable care and skill. I'm not responsible for losses that weren't foreseeable, or for business losses.
- If you're a business: my total liability for any project is limited to the price paid for it. I'm not liable for loss of profit, revenue, opportunity or goodwill, or for any indirect loss.
- I use professional equipment and back up footage confirm, e.g. dual card recording and two copies until delivery. If footage is lost or damaged through my fault, I'll offer to reshoot at no cost or refund the affected part of the fee.
13. Complaints
If something isn't right, email kian@kjgmedia.co.uk and I'll aim to resolve it quickly and fairly.
14. Law
These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction. If you're a consumer living in Scotland or Northern Ireland, you can also bring proceedings in your local courts.
